Diese Datenschutzerklärung gilt für die App „TCM Phyto“ für iOS und Android (in den App Stores auf Englisch „TCM Herbs“, auf Chinesisch „韓鵬 TCM Herbs“). Sie erläutert, welche Daten bei der Nutzung der App verarbeitet werden.
Das Wichtigste in Kürze: TCM Phyto ist ein Nachschlagewerk, das vollständig auf Ihrem Gerät arbeitet. Die App erhebt keine personenbezogenen Daten, benötigt kein Benutzerkonto, enthält weder Werbung noch Analyse- oder Tracking-Dienste und überträgt keine Daten – weder an uns noch an Dritte.

Die App funktioniert ohne Internetverbindung. Alle Inhalte – Arzneimittel, Rezepturen, Bilder und Aussprachen – sind Bestandteil der App. Die App ruft keine Internetadressen auf und sendet keine Daten an uns oder an Dritte.
Sie benötigt kein Benutzerkonto und fragt keine Zugriffsrechte ab, etwa auf Standort, Kamera, Mikrofon, Fotos oder Kontakte. Werbung sowie Analyse-, Tracking- oder Absturzberichtsdienste von Drittanbietern sind nicht eingebunden.
Notizen, die Sie zu Arzneimitteln und Rezepturen anlegen, sowie Einstellungen der App (zum Beispiel, ob die Einführung bereits angezeigt wurde) speichert die App ausschließlich lokal auf Ihrem Gerät. Wir haben darauf keinen Zugriff. Eine Notiz löschen Sie, indem Sie ihren Text in der App leeren; mit der Deinstallation der App werden alle lokal gespeicherten Daten entfernt.
Je nach Einstellung Ihres Geräts können diese Daten in die Gerätesicherung einbezogen werden (zum Beispiel iCloud-Backup oder Google-Sicherung). Diese Sicherung erfolgt durch Apple bzw. Google nach deren Datenschutzbestimmungen; wir erhalten dabei keine Daten.
Sie erhalten die App über den App Store von Apple oder über Google Play. Dabei verarbeiten Apple bzw. Google Daten wie Ihr Benutzerkonto, Ihre Gerätekennung und den Zeitpunkt des Downloads in eigener Verantwortung nach ihren Datenschutzbestimmungen; darauf haben wir keinen Einfluss.
Wir erhalten von den Anbietern lediglich zusammengefasste Statistiken ohne Personenbezug (zum Beispiel die Anzahl der Downloads) sowie – nur wenn Sie dies in den Einstellungen Ihres Geräts erlaubt haben – anonymisierte Absturz- und Diagnoseberichte.
Wenn Sie uns per E-Mail oder Telefon kontaktieren, verarbeiten wir Ihre Angaben, um Ihre Anfrage zu beantworten (Art. 6 Abs. 1 lit. b und f DSGVO), und löschen sie, sobald sie dafür nicht mehr benötigt werden und keine gesetzlichen Aufbewahrungspflichten bestehen. Für unsere Website gilt unsere allgemeine Datenschutzerklärung.
Sie haben das Recht auf Auskunft (Art. 15 DSGVO), Berichtigung (Art. 16 DSGVO), Löschung (Art. 17 DSGVO), Einschränkung der Verarbeitung (Art. 18 DSGVO), Datenübertragbarkeit (Art. 20 DSGVO) und Widerspruch (Art. 21 DSGVO). Außerdem können Sie sich bei einer Datenschutz-Aufsichtsbehörde beschweren (Art. 77 DSGVO); für uns zuständig ist das Bayerische Landesamt für Datenschutzaufsicht (BayLDA) in Ansbach.
Da die App keine Daten an uns übermittelt, liegen uns aus ihrer Nutzung keine personenbezogenen Daten über Sie vor.
Wir passen diese Datenschutzerklärung an, wenn sich die App oder die Rechtslage ändert. Es gilt die jeweils auf dieser Seite veröffentlichte Fassung.

This privacy policy applies to the app “TCM Herbs” for iOS and Android (called “TCM Phyto” in German and “韓鵬 TCM Herbs” in Chinese). It explains which data is processed when you use the app.
In short: TCM Herbs is a reference work that runs entirely on your device. The app does not collect any personal data, does not require an account, contains no advertising, analytics or tracking services and does not transmit any data – neither to us nor to third parties.

The app works without an internet connection. All content – herbs, formulas, images and pronunciations – is part of the app. The app does not access any internet addresses and does not send any data to us or to third parties.
It does not require an account and does not ask for permissions such as location, camera, microphone, photos or contacts. No third-party advertising, analytics, tracking or crash reporting services are included.
Notes you add to herbs and formulas, as well as app settings (for example, whether the introduction has already been shown), are stored only locally on your device. We have no access to them. You delete a note by clearing its text in the app; uninstalling the app removes all locally stored data.
Depending on your device settings, this data may be included in your device backup (for example iCloud Backup or Google backup). Such backups are made by Apple or Google under their own privacy policies; we do not receive any data.
You obtain the app from Apple’s App Store or from Google Play. Apple or Google process data such as your account, your device identifier and the time of the download under their own responsibility and privacy policies; we have no influence on this.
We only receive aggregated statistics without any personal reference (for example the number of downloads) and – only if you have allowed this in your device settings – anonymised crash and diagnostic reports.
If you contact us by email or phone, we process your details in order to answer your request (Art. 6(1)(b) and (f) GDPR) and delete them as soon as they are no longer required for this purpose and no statutory retention obligations apply. Our general privacy policy (in German) applies to our website.
You have the right of access (Art. 15 GDPR), rectification (Art. 16 GDPR), erasure (Art. 17 GDPR), restriction of processing (Art. 18 GDPR), data portability (Art. 20 GDPR) and objection (Art. 21 GDPR). You may also lodge a complaint with a data protection supervisory authority (Art. 77 GDPR); the authority responsible for us is the Bavarian Data Protection Authority (Bayerisches Landesamt für Datenschutzaufsicht, BayLDA) in Ansbach, Germany.
As the app does not transmit any data to us, we do not hold any personal data about you from your use of the app.
We will update this privacy policy if the app or the legal situation changes. The version published on this page applies. In the event of any discrepancy between the language versions, the German version shall prevail.
